1. Who we are

This website is operated by Fanatiko®. Throughout these Terms, “we”, “us” and “our” refer to Fanatiko®. Our full company and registered address details are set out in our Legal Notice. You can contact us at support@thefanatikobrand.com.

2. Scope

These Terms govern the use of this website and the purchase of products through it. By browsing the site or placing an order you accept these Terms in full. If you do not agree with them, please do not use the site.

These Terms are complemented by our Privacy Policy, our Return and Refund Policy, our Shipping Policy and our Legal Notice.

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order.

3. Products and availability

We do our best to describe and photograph every product accurately. Colours may vary slightly depending on your screen. Product availability is not guaranteed until the order is confirmed, and we may limit the quantities sold to any one customer.

We reserve the right to modify or discontinue any product at any time without notice.

4. Prices and taxes

All prices are shown in euros and include the applicable VAT unless stated otherwise at checkout. Shipping costs are shown separately before you confirm payment.

We reserve the right to correct obvious pricing errors. If an error affects an order you have already placed, we will contact you before dispatch and you may confirm the order at the correct price or cancel it at no cost.

5. Orders and formation of the contract

When you place an order you will receive an acknowledgement email. The sales contract is formed when we confirm dispatch of the products.

We may refuse or cancel an order where there is a pricing or description error, where payment cannot be authorised, where we suspect fraudulent use, or where we are unable to deliver to the address provided. If we cancel an order that has already been paid, we will refund it in full.

6. Payment

We accept the payment methods shown at checkout. Payments are processed by Shopify Payments and other authorised providers; we do not store your full card details on our systems.

7. Delivery

Delivery times, costs and coverage are set out in our Shipping Policy. Risk in the products passes to you on delivery.

8. Right of withdrawal and returns

As a consumer in the European Union you have the right to withdraw from your purchase within 14 calendar days of receiving the goods, without giving any reason. The conditions, the cost of return shipping and the refund process are set out in our Return and Refund Policy.

The right of withdrawal does not apply to customised or personalised products, in accordance with Spanish and European consumer law.

9. Guarantees

All our products carry the legal conformity guarantee granted by the consumer law of your country of residence, which is two years in most of the European Union and three years in Spain. In addition, we offer a commercial 90-day guarantee against manufacturing defects, described in our Return and Refund Policy. The commercial guarantee never replaces or reduces your legal rights.

10. Acceptable use of the site

You agree not to use this site for any unlawful purpose, not to attempt to gain unauthorised access to it, not to introduce viruses or harmful code, and not to reproduce, copy or exploit any part of the site or its contents for commercial purposes without our written permission.

11. Intellectual property

All content on this site, including text, images, designs, logos and the Fanatiko® trade mark, belongs to us or is used under licence, and is protected by intellectual and industrial property law. Nothing in these Terms grants you any right over that content.

12. Reviews and content you submit

If you send us reviews, photographs or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce and display it in connection with our products and brand. You are responsible for the content you submit, and it must not be unlawful, offensive or infringe the rights of third parties. We may remove any content at our discretion.

13. Liability

We are liable for damages caused by our failure to comply with these Terms, in accordance with applicable law. We do not exclude or limit our liability in cases where the law does not allow it, in particular for death or personal injury caused by our negligence, for fraud, or for our obligations under consumer protection law.

We are not responsible for interruptions of the site caused by circumstances beyond our reasonable control.

14. Changes to these Terms

We may update these Terms at any time. The version published on this page at the moment you place an order is the one that applies to that order.

15. Governing law and dispute resolution

These Terms are governed by Spanish law. Nothing here deprives you of the protection granted by the mandatory consumer law of your country of residence.

If you are a consumer and we have not been able to resolve a complaint, you may use the European Commission's online dispute resolution platform at https://ec.europa.eu/consumers/odr.
